UNCLE SENTENCED TO LIFE IMPRISONMENT FOR RAPING HIS NIECE

Hertzogville, Free State – The National Prosecuting Authority (NPA) welcomes the life sentence imposed by the Hertzogville Regional Court on a 54-year-old man for raping his niece, who had been entrusted to his care.

The court heard that the child’s mother had placed her in the care of the accused and his wife while she worked outside the province. In June 2024, the accused betrayed that responsibility by raping the child.

On the night of the incident, the child was watching television when the accused called her to join him under his blankets. He instructed her to undress and raped her.

The child disclosed the rape to her mother in June 2025. She had delayed reporting the incident because she feared the accused. Her experience highlights how fear can prevent children from immediately disclosing sexual abuse.

During the trial, clinical forensic nurse Mabel Mercy Kivido testified about findings from her examination of the child. The J88 medical examination report, compiled with the involvement of the Thuthuzela Care Centre (TCC), formed part of the evidence presented to the court.

The State also presented a victim impact statement, compiled with the assistance of Court Preparation Officer Rosy Gaopalelwe Sebego, detailing the trauma the child suffered.

In aggravation of sentence, Prosecutor Gundo Jeaffrey Siphugu argued that there were no substantial and compelling circumstances justifying a departure from the prescribed minimum sentence. He emphasised that rape is a brutal violation of a victim’s dignity, privacy and bodily integrity.

The court accepted the State’s submissions and sentenced the accused to life imprisonment.

The NPA condemns the sexual abuse of children, particularly by family members and caregivers entrusted with their protection. This sentence holds the perpetrator accountable for violating a child’s rights and betraying the trust placed in him.

The NPA remains committed to prosecuting sexual offences and ensuring that victims receive the support they need to pursue justice. Prosecutors, TCC personnel and Court Preparation Officers play a vital role in helping children participate in the criminal justice process with dignity.

Parents, caregivers and communities are urged to create safe spaces for children to disclose abuse without fear. Disclosures must be taken seriously, and children must be protected and supported. Anyone with knowledge of child sexual abuse is urged to report it to the authorities.
