NPA RECEIVES INTERIM REPORT ON INVESTIGATIONS AND WITHDRAWS SUSPENSION LETTER OF ADV NTABA
On 02 June 2026, the Office for Ethics and Accountability (OEA) in the National Prosecuting Authority (NPA) submitted an interim report into the circumstances that led to the events that took place on 15 and 18 May 2026 regarding the matter of State versus Madoda Johannes Sibanyoni and Others. The interim report noted that there are outstanding investigations that still need to be conducted before a final report can be completed. Upon consideration of the interim report, the National Director of Public Prosecutions (NDPP), Adv Andy Mothibi in consultation with the Director of Public Prosecutions (DPP), Mpumalanga Division Adv Sonja Ntuli directed that the letter of suspension in respect of Adv Ntaba be withdrawn and that he be allowed to return to work.
The decision to withdraw the suspension letter is based on the verified version of Adv Ntaba relating to his safety and by the OEA’s view that Adv Ntaba has cooperated with them and that there is no likelihood that he will interfere with the outstanding investigations. The NDPP, Adv Mothibi said “I have appealed to the OEA to consider including recommendations in the final report regarding measures to be put in place to further improve process regarding provision of security to prosecutors and other staff”.
I have further implored them to consider further recommendations regarding adequate quality assurance measures to be put in place to avoid recurrence of this unprecedented situation anywhere in the NPA”.
Regarding the leave to appeal against the order for contempt of court and warrant of arrest, our legal team received written reasons that were requested from Chief Magistrate Tonjeni and supplemented our grounds for appeal accordingly. We are awaiting date of the hearing of the leave to appeal from the Clerk of the Kwaggafontein Magistrates Court. The state attorney also wrote to the attorneys representing accused number 1 and 5 demanding that they tender costs for the withdrawal of the urgent application for an interdict against the execution of the J50 warrants of arrest in line with the Uniform Rules of Court.
We can assure the public that this matter will be handled fairly in the interest of the NPA and the public while also safeguarding the interests of Adv Ntaba.
