MAN SENTENCED FOR RAPE OF 71-YEAR-OLD WOMAN NEIGHBOUR
The Zwelitsha Regional Court has sentenced Thembela Majiya (34) to 23 years’ direct imprisonment for the rape of a 71-year-old woman. The offence occurred in the early hours of 11 August 2024 in Zwelitsha. The complainant, who lives alone, was asleep at her home when she was awakened at approximately 01h00 by the sound of a window breaking. On investigation, she discovered that a kitchen window had been broken. Shortly thereafter, the accused, who is her neighbour, called out to her, claiming that he had seen unknown people leaving her yard. He offered to assist in fixing the broken window. Trusting him, the complainant allowed the accused into her home.
As the complainant walked ahead of the accused towards the kitchen, he suddenly grabbed her from behind and dragged her into the bedroom. During the attack, the accused threatened her, stating: “I will do what I did to my aunt; it is now your turn.” He then forcibly undressed and raped her. After committing the offence, he threatened to send his friends to kill her should she report the incident. After the accused left, the complainant managed to send a message to her niece, who immediately contacted her telephonically. The incident was reported, and family members rushed to the complainant’s home. Upon arrival, they observed the broken kitchen window and were informed of what had transpired. Two male relatives went in search of the accused and found him hiding in a toilet at his residence. They brought him to the complainant’s home, where the police were summoned, and the accused was arrested. The complainant was taken for a medical examination, and a case was opened.
During the trial, the State led evidence from the complainant, who testified consistently with the events of the night. Her niece confirmed receiving a distress message from the complainant at around 04h00 and testified that she alerted other family members. A neighbour, who was contacted due to his proximity to the complainant’s residence, was the first to arrive at the scene and assisted in locating and apprehending the accused. Medical evidence was also presented, confirming injuries consistent with sexual assault.
In his defence, the accused admitted that he went to the complainant’s home but denied raping her. He claimed that the complainant had called him to assist with fixing the broken window and that he left to look for materials to repair it. He alleged that he was on his way back when he was confronted by the complainant’s relatives and was shocked by the allegations.
The court rejected the accused’s version as false and found him guilty of rape. He was subsequently sentenced to 23 years’ direct imprisonment.
Welcoming the sentence, Eastern Cape Director of Public Prosecutions, Mr Barry Madolo, said the outcome demonstrates the National Prosecuting Authority’s unwavering commitment to protecting the most vulnerable members of society and ensuring that perpetrators of sexual violence are held fully accountable. He commended Regional Court Prosecutor Msuthukazi Pango, Court Preparation Officer Phelisa Matinise, the investigating officer, and staff at the Thuthuzela Care Centre for their dedication and professionalism in supporting the complainant and securing a successful conviction.
