RAPIST SENTENCED TO LIFE IMPRISONMENT

Bethlehem, Free State – The Bethlehem Magistrate’s Court has sentenced Thato Joseph Motholo (28) to life imprisonment for the rape of a 34-year-old woman during a brutal home invasion in Clarens on 8 May 2022.

The court convicted him on two counts of rape after he forcibly entered the complainant’s home and sexually assaulted her in the presence of her two minor children. On the night of the incident, the complainant was asleep with her children while her husband worked a night shift. At around 2:00 a.m., Motholo unlawfully entered the home armed with a screwdriver, using it to threaten her before raping her twice and fleeing.

The victim reported the assault to her husband upon his return at 6:00 a.m., and the matter was immediately reported to the South African Police Service, leading to the accused’s swift arrest. During the trial, Motholo claimed the encounter was consensual, alleging a prior arrangement and an earlier visit, but the court rejected this version as untruthful. The complainant’s credible testimony secured his conviction.

State Advocate Nolubabalo Twalo argued for a life sentence, highlighting Motholo’s lack of remorse and the absence of substantial or compelling circumstances to deviate from the prescribed minimum. She emphasised the severity of gender-based violence and femicide (GBVF), urging a strong deterrent message. The court concurred, sentencing Motholo to life imprisonment.

The National Prosecuting Authority (NPA) welcomes this outcome, reaffirming its unwavering commitment to justice. This conviction delivers closure to the victim and her family while removing a dangerous offender from society, protecting the constitutional rights to dignity, safety, and justice for all.
