TWO LIFE AND EIGHT YEARS IMPRISONMENT
The Madadeni Regional Court has sentenced a 33-year-old man to a double life and eight years imprisonment for the rapes and robbery he committed in Osizweni in September 2023. The complainants were sisters aged 12 and 23 years old at the time. The complainants lived together, and the older complainant took care of her own children, as well as her siblings (including the 12-year-old complainant).
On the evening of 10 September 2023, they were at home when the accused broke down the door and entered their house. He approached the older complainant and demanded a cellphone from her whilst assaulting and threatening her with a knife. She handed her phone over to him. He then proceeded to rape her. Her child began crying, and the accused instructed the complainant to hand the child over to the second (younger) complainant, who was sleeping in the same room. The accused then raped the older complainant again. Thereafter, he raped the younger complainant. The accused raped both the complainants on more than one occasion and eventually fled the scene. Thereafter, the complainants went outside and reported the matter to their neighbour.
The community members gathered at the complainants’ home, and one of them noticed a suspicious male (the accused) walking up and down the street. They approached him, and the police were called. The accused was arrested. The complainants were taken to Madadeni Thuthuzela Care Centre (TCC) for medical attention and psychosocial support.
In court, Prosecutor Khethiwe Kunene led the evidence of the complainants, the doctor who examined them, as well as the content of the J88 form. Community members also testified for the state. Further, DNA evidence linking the accused to the crime was handed in to the court. The complainants’ aunt told the court that the complainants were highly traumatised, and she had to relocate them to another province to live with her.
In aggravation of sentence, Kunene handed in Victim Impact Statements (VIS) compiled by the complainants and facilitated by Deputy Director for Court Preparation in KZN, Xolile Mzobe. In their statements, the complainants said they no longer feel safe, and they no longer trust people. The accused was sentenced to life imprisonment for each count of rape, three years imprisonment for housebreaking with intent to commit a crime unknown, and five years imprisonment for robbery with aggravating circumstances. He was declared unfit to possess a firearm, and the court ordered that his name be entered into the National Register for Sex Offenders.
The NPA’s fight against the scourge of sexual violence has been aided by the expansion of the TCC footprint across the country, which has grown from 55 TCCs in 2020/2021 to 66 TCCs at present. The TCCs provide comprehensive services and support to victims of sexual violence. We hope that this sentence conveys the NPA’s stance on gender-based violence and sexual offences.
