Suspended Police Sergeant Sentenced For Rape

The Kimberley Regional Court has sentenced the suspended police Sergeant Wayne Mbayeka (45), to life imprisonment for two counts of rape. The court also declared the accused unfit to possess a firearm. On the day of the incident, the accused was off-duty and was approached by the 43-year-old victim, who asked for a lift as the accused was a well-known and respected member of the police within the communities of Kimberley.

During their interaction, the accused forced himself on the victim and continued to rape her. The victim called for help and members of the community called the police, who arrested and charged the accused with two counts of rape.

Mbayeka’s bail application was unsuccessful and he was remanded in custody until the conclusion of his trial. The South African Police Service(SAPS) suspended the accused without pay. Prosecutor Belinda Thomas argued that the court should impose the maximum sentence applicable for the crime committed, taking into account that the accused betrayed the community which trusted and respected him as a member of the police. 

The Director of Public Prosecutions in the Northern Cape, Adv. Abraham Botha commended the good work that was done by the investigating officer and the prosecution team.
