NPA WELCOMES 22-YEAR IMPRISONMENT SENTENCE FOR RAPE OF ELDERLY WOMAN

Thohoyandou, Limpopo – The National Prosecuting Authority (NPA) welcomes the 22-year direct imprisonment sentence imposed by the Sibasa Regional Court on a 59-year-old man from Tshilapfene for the rape of a 71-year-old woman.

The accused's identity is being withheld to protect the victim's identity and prevent secondary victimisation. In addition to the custodial sentence, the court ordered that the accused's particulars be entered into the National Register for Sex Offenders and declared him unfit to possess a firearm.

The accused pleaded not guilty to the charge. During the trial, the court heard that the accused and the victim were neighbours. In 2019, after observing the victim returning home from a bus stop, the accused followed her to her homestead in Tshilapfene. He entered her residence, proceeded to her bedroom, and a struggle ensued before he raped her. Following the incident, the victim sought medical assistance at a nearby clinic and was subsequently referred to the Tshilidzini Thuthuzela Care Centre for further care and support. The matter was reported to the police, leading to the accused's arrest and prosecution.

During sentencing proceedings, State Prosecutor Muligi Mphedziseni Eric argued for the prescribed sentence of life imprisonment, submitting that the victim qualified as an older person in terms of the Older Persons Act 13 of 2006. The State further argued that the victim was raped in the sanctity of her own home, a place where she should have felt safe and secure. The prosecution emphasised the severe trauma suffered by the victim at the hands of a person she knew and trusted as a neighbour.

The State further submitted that there were no substantial and compelling circumstances justifying a deviation from the prescribed minimum sentence. After considering all the evidence and arguments before it, the court sentenced the accused to 22 years' direct imprisonment.

Welcoming the sentence, the Director of Public Prosecutions in Limpopo, Advocate Ivy Thenga, said the outcome demonstrates the NPA's unwavering commitment to securing justice for victims of Gender-Based Violence and protecting vulnerable members of society. Advocate Thenga further commended State Prosecutor Muligi Mphedziseni Eric, the investigating officer, and all role players involved in the case for their dedication, professionalism, and commitment in ensuring a successful prosecution.

The NPA remains committed to holding perpetrators of sexual offences accountable and ensuring that victims receive the support, dignity, and justice they deserve.
