NPA SUCCESSFULLY OPPOSES BAIL IN GQEBERHA CHILD PORNOGRAPHY AND RAPE CASE
The National Prosecuting Authority (NPA) has successfully opposed the bail application of 38-year-old Ryno Du Toit in the Gqeberha Magistrates' Court. The accused faces serious Schedule 6 charges, including the rape of a minor as well as multiple offences relating to the possession, creation and distribution of child sexual abuse material.
Du Toit was arrested on 10 January 2026 at his residence in Sydenham, Gqeberha, following a tip-off that a cellphone number linked to him was allegedly being used to distribute pornographic material.
The State alleges that the accused was found in possession of at least 10 videos depicting child sexual abuse material and bestiality. It is further alleged that he distributed such material via email and produced a video in 2025 depicting himself engaging in sexual activity with a two-year-old male child. The identity of the child remains unknown, and investigations to trace and identify the victim are ongoing.
In his affidavit before the court, the accused denied the allegations and indicated his intention to plead not guilty. During the bail proceedings, Prosecutor Asavela Dweba argued that the State has a strong prima facie case against the accused. While bail proceedings are not punitive, the State submitted that the accused poses a significant flight risk, given the seriousness of the charges and the likelihood of a lengthy custodial sentence if convicted.
The court was further informed that the accused has a passport and may interfere with ongoing investigations or attempt to destroy electronic evidence stored on digital devices and cloud-based platforms. Concerns were also raised that the minor depicted in the material may still be at risk.
The State submitted that the accused had not cooperated with law enforcement authorities and had not assisted in efforts to identify the minor victim. Considering the seriousness of the offences, the vulnerability of the child involved, and the ongoing investigation, the court found that it would not be in the interests of justice to release the accused on bail and accordingly denied.
The matter has been postponed to 08 June 2026 for further investigation.
