MAN SENTENCED TO 15 YEARS' IMPRISONMENT FOR MURDER OVER CIGARETTE MONEY

Vioolsdrift, Northern Cape – The Springbok Regional Court has sentenced 36-year-old Brian Klaase to 15 years' imprisonment for the murder of 25-year-old Reagan Austin Losper following a dispute over money that had been entrusted to the deceased to purchase cigarettes.

The National Prosecuting Authority (NPA), Northern Cape Division, welcomes the sentence following the successful prosecution of Klaase for the unlawful killing of Losper in Vioolsdrift, a small town near the Namibian border.

The court heard that Klaase and Losper knew one another and both resided in Vioolsdrift. On 27 April 2024, the two men were near a local shop when an argument erupted. Klaase demanded to know what had happened to the money he had given Losper to buy cigarettes. Losper told him that he no longer had the money.

Angered by the response, Klaase produced a knife and repeatedly stabbed Losper without warning. The deceased attempted to defend himself by blocking the blows but was unable to prevent the attack and sustained multiple stab wounds.

Losper managed to flee and ran towards the police station. Klaase pursued him until the deceased's brother intervened by throwing stones at the accused to stop the attack. Klaase then retreated towards the shop and threatened bystanders, warning them that they would also be harmed if they spoke about the incident.

Meanwhile, Losper, having lost a substantial amount of blood, became weak and collapsed on the N7 National Road. He succumbed to his injuries and was declared dead at the scene.

A post-mortem examination revealed that the deceased sustained a penetrating stab wound to the base of the right side of his neck, causing damage to the right subclavian vein, as well as injuries to the thoracic cavity and right lung. The cause of death was determined to be a stab wound to the neck.

Following the incident, members of the community confronted Klaase and attempted to assault him. He subsequently handed himself over to the police. After his arrest, he abandoned his bail application and remained in custody until the finalisation of the matter.

The court further heard that Klaase disposed of the murder weapon and the T-shirt he had been wearing during the incident by throwing them into a river.

In admissions made before the court, Klaase acknowledged that he stabbed Losper because he was angry. He conceded that he was not acting in self-defence and that his life was not in danger when he attacked the deceased. He further admitted that, although he did not directly intend to kill Losper, he knew that stabbing him in the way he did could result in death.

Klaase also acknowledged that he was fully aware of his actions and understood that his conduct was unlawful and punishable by law.

In aggravation of sentence, Regional Court Prosecutor Basil Kock argued that there were no substantial and compelling circumstances justifying a deviation from the prescribed minimum sentence of 15 years' imprisonment.

The court agreed with the State's submissions and imposed the prescribed sentence of 15 years' direct imprisonment.

This sentence demonstrates that acts of violence, particularly those arising from seemingly trivial disputes, can have irreversible and devastating consequences.

The NPA remains committed to ensuring that perpetrators of serious violent crimes are brought before the courts and that the interests of victims, their families, and affected communities are properly placed before the courts for consideration.
