MAN SENTENCED TO 10 YEARS IMPRISONMENT FOR RAPING HIS GIRLFRIEND
Garies, Northern Cape - Mario Kobus (38) has been convicted and sentenced to 10 years of direct imprisonment for raping his girlfriend, who is also the mother of his child, by the Garies Regional Court. Furthermore, the accused was declared unfit to possess a firearm in terms of Section 103 of the Firearms Control Act 103 of 2000.
The incident occurred on 21 December 2023 in the rural town of Nourivier. On the day of the incident, Kobus went to the complainant’s home, locked the doors, closed the curtains, and launched a violent attack on her. He threw her on the bed, forcefully pulled down her pants, and had sexual intercourse without her consent. The complainant, who was crying and too weak to resist, was left traumatised by the ordeal. After raping his girlfriend, the accused left the scene, and the victim reported the matter to her mother, who immediately contacted the police. Kobus was arrested soon afterwards and remained in custody until the conclusion of his trial. The case was prosecuted under the provisions of the Criminal Law (Sexual Offences and Related Matters) Amendment Act, No. 32 of 2007, read in conjunction with the Criminal Law Amendment Act, No. 105 of 1997, and the Criminal Procedure Act, No. 51 of 1977.
Regional Court Prosecutor Basil Kock represented the State and successfully secured the conviction and sentence. The Office of the Director of Public Prosecutions in the Northern Cape welcomes this outcome. Intimate partner violence and sexual abuse remain serious crimes that devastate individuals, families, and communities. All cases of sexual violence encroach on the rights to dignity and privacy of the victims as enshrined in our constitution, hence the NPA aggressively prosecutes these cases. The NPA remains resolute in its mandate to bring perpetrators of gender-based violence before the courts and to ensure that survivors of these crimes receive justice.
