LIFE AND FIVE YEARS IMPRISONMENT FOR RAPE AND SEXUAL ASSAULT 

The Mtubatuba Regional Court has sentenced a 34-year-old man to life and five years imprisonment for the rape and sexual assault of two children aged seven and five years old in the KwaMsane area in December 2023. 

The accused was attending a traditional ceremony at the complainant’s home when he saw the complainant playing outside. He promised to give them money and asked them to follow him to an outside bathroom. Once in the bathroom, the accused raped the first complainant and sexually assaulted the other. During the incident, one of the complainants’ cousins came to use the bathroom and saw them running out. The cousin found the accused pulling up his pants. The matter was reported to the police, and the accused was arrested. 

In court, the Prosecutor Sphelele Precious Mdluli led the evidence of the complainants and the cousin who had walked in on the incident. The complainant’s guardian, as well as the medical practitioner who examined them, also testified in the state’s case. In aggravation of sentence, Ms. Mdluli handed in Victim Impact Statements which were compiled by the complainants and facilitated by Court Preparation Officer Sthembile Cebekhulu. The accused was sentenced to life imprisonment for rape and five years imprisonment for sexual assault. In addition to the sentence, he was declared unfit to possess a firearm. The court also ordered that his name be entered into the National Register for Sex Offenders. 

The National Prosecuting Authority (NPA) welcomes the successful conviction and sentence. The NPA remains resolute in our pursuit of justice for victims of child abuse. We will continue to protect the rights and dignity of children.
