DOUBLE LIFE IMPRISONMENT FOR RAPING MINORS 

Madadeni, KwaZulu-Natal – The Madadeni Regional Court has sentenced a 25-year-old man to two terms of life imprisonment for the rape of two minor boys in August 2024 in the Osizweni area, on the outskirts of Newcastle. The complainants, who were aged 13 (first complainant) and 9 years old (second complainant) at the time of the offence were friends. On the day of the incident, they were playing together at the first complainant’s house. The first complainant’s sister asked them if they wanted to accompany her to her friend’s house where she was going to study. The complainants agreed and they went with her to the house which was situated nearby. 

While the sister and her friend studied inside the house, the complainants played outside. After some time, the accused arrived at the house and called the complainants into the garage. When the complaints entered the garage, they realised that the garage had been converted into a bedroom. The accused locked the door and proceeded to rape the complainants one at a time. Thereafter he let them go. The complainants returned to where they had been playing and waited for the first complainant’s sister to finish studying. Afterwards, the three of them walked back home, and the complainants did not report the incident to anyone. 

A week later, while the first complainant was at school, his teacher observed that he (the complainant) looked unwell. When asked, the complainant said that he felt sick and wanted to go home. His grandmother was called to school and as she and the complainant walked back home, he confided in her that he had been raped. He was taken to the Madadeni Thuthuzela Care Centre (TCC) where he was examined by the doctor there. The first complainant’s grandmother then went to the home of the second complainant and told his mother about the rape. The second complainant then confirmed that he too had been raped. This complainant was also taken to the Madadeni TCC for assistance. The complainants subsequently identified the accused (in the presence of the police) and the accused was arrested. 

Representing the state in court, Prosecutor Cindy-Lee Alberts led the testimonies of the complainants, the granny and sister of the first complainant, and the mother of the second complainant. Further evidence for the state included the evidence of the investigating officer and the medical doctor who had conducted a medical examination on both the complainants. The state also handed in Victim Impact Statements (VISs) compiled by the complainants wherein both complainants mentioned that they were fearful of the accused when the incident happened. They also described the physical and emotional trauma they experienced following the incident. The complainants further said that they now have trust issues and are fearful of strangers. 

In addition to the life sentences, the court found the accused unsuitable to work with children. The court declared him unfit to possess a firearm and ordered that his name be entered into the National Register for Sex Offenders.

The NPA’s fight against the scourge of sexual violence has been aided by the expansion of the TCC footprint across the country, which has grown from 55 TCCs in 2020/2021 to 66 TCCs at present. These centres provide comprehensive services and support to victims of sexual violence
