20 YEARS FOR FATHER WHO RAPED AND SEXUALLY ASSAULTED 9-YEAR-OLD DAUGHTER
Roodepoort, Gauteng – The Roodepoort Magistrates’ Court has sentenced a 38-year-old father to an effective 20 years’ imprisonment for raping and sexually assaulting his biological 9-year-old daughter in 2021. The offences occurred in Roodepoort. The sentencing was delivered today, 30 October 2025.
The matter surfaced when the victim’s mother returned from smoking outside and witnessed the accused inserting his finger into the child’s private parts while they sat on the sofa under a blanket. He quickly pulled up his trousers, acted as if nothing had happened, and offered coffee. The mother reported the incident to the Roodepoort Police Station, leading to his arrest on 18 May 2021. Investigations by Sergeant Ditsi revealed he had, on separate occasions, touched the child’s private parts and exposed himself to her. The state called the mother, who testified that the child now struggles to make friends, withdraws socially, performs poorly academically, suffers low self-esteem, and walks with her head down.
Regional Court Prosecutor Kelebogile Sibi highlighted the offence’s gravity, the child’s vulnerability, and the father’s betrayal of his legal and moral duty to protect her. Magistrate Anneline Africa considered the accused’s authority as the child’s guardian. Applying proportionality, she departed from the prescribed life sentence, balancing punishment with its objectives. The accused received 20 years for rape and 5 years for sexual assault, running concurrently, for an effective 20 years. All sexual violence violates victims’ constitutional rights to dignity and bodily integrity.
