NPA SECURES CONVICTION AND SENTENCE IN SARS FRAUD CASE

Zeerust, North West – The National Prosecuting Authority (NPA), through its Specialised Tax Unit, has successfully secured the conviction and sentencing of 47-year-old Patrick Mafa for defrauding the South African Revenue Service (SARS) of more than R42 000 in customs and tax revenue.

The Zeerust Magistrate’s Court sentenced Mafa to a R10 000 fine and 12 months’ imprisonment, wholly suspended for three years, following the conclusion of criminal proceedings arising from an incident that occurred on 28 March 2023.

Evidence before the court established that Mafa submitted documentation relating to a load that was purportedly destined for Botswana. However, he proceeded to the Kopfontein Border Post without first collecting the load from Value Logistics.

Upon arriving at the border post, Mafa became aware that the truck was empty. Despite knowing that no goods were being transported, he presented export documentation reflecting purported goods to a SARS Customs official.

As a result of this misrepresentation, SARS Customs processed the documentation, causing SARS to suffer a loss of R42 362.25 in customs duties and tax revenue.

Mafa subsequently entered into a plea and sentence agreement with the State. In terms of the agreement, the court imposed a sentence of a R10 000 fine and 12 months’ imprisonment, wholly suspended for three years on condition that he is not convicted of contravening the Customs and Excise Act during the period of suspension.

The Director of Public Prosecutions in the North West Division, Dr Rachel Makhari, welcomed the successful prosecution and sentence, emphasising the detrimental impact of tax-related offences on the country's economy and revenue collection efforts.

“This sentence sends a clear message that tax and customs-related crimes are serious offences with significant consequences. Individuals who deliberately misrepresent information to evade their legal obligations will be held accountable through the criminal justice system. Such conduct not only prejudices state institutions but also undermines South Africa’s efforts to promote sustainable economic growth and development,” said Makhari.

The NPA remains committed to working closely with SARS and other law enforcement partners to combat tax fraud, protect the country's revenue base, and ensure that offenders are brought to justice.
