DE AAR MAN SENTENCED TO 10 YEARS IMPRISONMENT FOR MURDER
De Aar, Northern Cape – The De Aar Regional Court has sentenced Sivuyile Nyember (26) to 10 years’ direct imprisonment for the murder of 38-year-old Collin Badenhorst. The sentence follows Nyember’s guilty plea to the charge of murder. The incident occurred on 20 November 2024, when the accused, who had been attending a traditional ceremony and consuming alcohol, encountered the deceased while on his way home to fetch a jacket. The accused asked the deceased for a cigarette. When the deceased refused and swore at him, Nyember drew a knife and stabbed him in the back before fleeing the scene. The deceased was hospitalised but later succumbed to his injuries on 12 December 2024, prompting the charge to be upgraded from assault with intent to do grievous bodily harm to murder.
During sentencing on 10 November 2025, the court considered a Victim Impact Statement compiled by the deceased’s cousin with assistance from Court Preparation Officer Trott Manghana. Prosecutor Xolisa March emphasised that the court must send a strong message that the senseless taking of a human life will not be tolerated.
In handing down the sentence, the court noted that Nyember had pleaded guilty, expressed remorse, and was a first-time offender. These factors were regarded as substantial and compelling circumstances justifying a deviation from the prescribed minimum sentence. Nyember was also declared unfit to possess a firearm.

The sanctity and value of human life must never be diminished, and those who choose to take it away will face the full force of the law.
