Life Imprisonment for Raping Minor
The Madadeni Regional Court has sentenced a 31-year-old man to life imprisonment for the rape (on two occasions) of a 10-year-old girl in December 2020 in the Osizweni area. The complainant who lived with her mother occasionally visited her father in Osizweni. Her father rented a room on a homestead belonging to an old lady who brewed and sold traditional beer. The accused often visited this homestead as he helped the old lady to brew the beer.
On 05 December 2020, the complainant was visiting her father and she and the accused were helping to brew the traditional beer in the old lady’s garage. Once they were alone the accused shut the door and raped the complainant. Thereafter he threatened to kill her if she told anyone what he had done. The complainant left and did not tell anyone what had happened. A few weeks later she returned to visit her father, and the accused raped her once again when she was alone with him. The following day the complainant returned home to her mother and her mother noticed that she was having difficulty in walking. When her mother asked the complainant what was wrong, the complainant revealed what the accused had done to her.
The complainant was taken to the Madadeni Thuthuzela Care Centre (TCC) where the doctor examined her, confirming that she had fresh injuries consistent with the recent incident and older injuries consistent with the previous incident. The complainant and her mother reported the matter to the police, and the accused was arrested. As part of the state’s evidence. Prosecutor Cindy-Lee Alberts led the testimony of the mother, who was the first report. The mother told the court that the incident has left the complainant highly traumatised, and she lives in fear of the accused. Her schoolwork has suffered, and she is even scared to visit her father.
In addition to the life sentence, the accused was declared unfit to possess a firearm. The court also declared him unsuitable to work with children and ordered that his name be entered into the National Register for Sex Offenders.
The NPA welcomes this successful prosecution. This sentence is indicative of the seriousness with which the NPA views such crimes.
