UNCLE GETS 10 YEARS IMPRISONMENT FOR ASSAULT GBH
The Mtubatuba Regional Court has sentenced a 51-year-old man to 10 years imprisonment for the assault with intent to do grievous bodily harm (Assault GBH) of his 13-year-old niece in April 2025. The accused and the complainant lived in the same homestead, and on the day of the incident, the accused arrived home and found his sister (the complainant’s mother) seated with her three children. Brandishing a bush knife, he approached his sister, swore at her, and threatened to kill her.
The accused then turned to the complainant and asked her why she was looking at him. Before the complainant could reply, the accused hit her with the bush knife. She tried to block him and was injured on her palm and thumb, sustaining an open wound and fracture to her thumb. The complainant was taken to the hospital, and the matter was reported to the police. The accused was subsequently arrested.
In aggravation of sentence, Prosecutor Siphelele Precious Mdluli told the court that the accused was an elder to the complainant and her mother, and he had an obligation to protect them. Instead, he became the perpetrator. The state also handed in a Victim Impact Statement (VIS) compiled by the complainant’s mother and facilitated by Court Preparation Officer Sithembile Cebekhulu. In her statement, the woman said that they are traumatised by the accused’s actions and are now terrified of him. The accused was convicted and sentenced accordingly.
