20 YEARS IMPRISONMENT FOR RAPIST

The Madadeni Regional Court has sentenced a 28-year-old man to 20 years direct imprisonment for the March 2024 rape of a 36- year- old woman in Mndozo Farm. While the accused was charged with rape which attracts the minimum sentence of life imprisonment, the court deviated from this. The court’s reasoning was because the accused had made Section 220 admissions to the court, following the complainant’s testimony. In his admissions, the accused said that he had raped the complainant. The court considered this to be a sign of remorse and deviated from the sentence of life imprisonment. The accused, the complainant and the complainant’s boyfriend all knew each other.

Prior to the incident, the complainant and her boyfriend were at a tavern together, when the accused joined them. When it was time to leave, the accused asked them (the complainant and her boyfriend) for a lift. They first dropped the complainant at her home, then the boyfriend drove the accused to his place. Once the complainant was inside her house, she went to bed. She did not lock the door because they had agreed that her boyfriend would come back to her house after dropping off the accused. After being dropped off by the complainant’s boyfriend, the accused did not go into his house. Instead, he walked back to the complainant’s house. Since the door was unlocked, he went in and found her sleeping and proceeded to rape her. The complainant tried to fight him off, but he injured her by digging his fingernails into her skin. He then ran away. The complainant reported the matter to the police; and she was taken to the Madadeni Thuthuzela Care Centre (TCC).

The accused was arrested at his homestead. In court, the Prosecutor Zama Zikalala led the evidence of the complainant and the medical doctor who examined her. The J88 form was also handed in to bolster the state’s case. Following the complainant’s testimony, the accused advised the court (via his legal representation) that he wanted to make Section 220 admissions. He then admitted to raping the complainant, in accordance with her testimony. The accused was sentenced accordingly, and he was declared unfit to possess a firearm. the court also ordered that his name be entered into the National Register for Sex Offenders.
