FOOTBALLER PLEADS GUILTY AND IS CONVICTED OF CULPABLE HOMICIDE
The National Prosecuting Authority (NPA) welcomes the conviction of Mokete Sean Mogaila (29), after he pleaded guilty to charges of culpable homicide and failure to render assistance.
Mogaila appeared before the Tembisa Magistrates’ Court, where he entered a guilty plea in terms of Section 112(2) of the Criminal Procedure Act. In his plea statement, he admitted to all the elements of the offences and accepted the facts and allegations presented by the State.
The charges arise from a fatal motor vehicle collision that occurred during the early hours of 30 October 2024 on Andrew Mapheto Road in Tembisa. Mogaila admitted that the vehicle he was driving veered into oncoming traffic and collided with another vehicle occupied by a woman and her two children.
The collision claimed the life of nine-year-old Gomolemo Mavimbela, while her mother and 13-year-old brother sustained serious injuries.
Following the crash, Mogaila fled the scene but later handed himself over to law enforcement authorities on the same day. During the investigation, police discovered alcohol bottles and drugs inside his vehicle.
The court subsequently convicted Mogaila on all three charges following his guilty plea. The matter has been postponed to 17 November 2026 for sentencing proceedings.
The NPA welcomes the guilty plea and conviction, which not only hold the accused accountable for his unlawful conduct but also spare the victims and their family the emotional burden of a lengthy trial. The conviction represents an important step towards justice for the deceased child and her family.
The NPA remains committed to ensuring accountability for individuals whose unlawful and reckless actions result in death or serious injury. Prosecutors will continue to pursue justice on behalf of victims while safeguarding the constitutional rights of accused persons and upholding the principles of due process.
