NPA WELCOMES EIGHT-YEAR SENTENCE FOR MAN CONVICTED OF RAPING HIS GIRLFRIEND

Rustenburg, North West – The National Prosecuting Authority (NPA) welcomes the eight-year direct imprisonment sentence imposed by the Bafokeng Regional Court on 31-year-old Odirile Modise following his conviction for the rape of his girlfriend.

The conviction and sentence stem from an incident that occurred in Tlhabane on 11 November 2023. On the day of the offence, Modise was with his girlfriend when he requested that she engage in sexual intercourse with him. The complainant refused, explaining that she was tired. Despite her clear refusal, Modise proceeded to sexually penetrate her without her consent.

The complainant reported the matter to the police, leading to the opening of a rape case and the subsequent arrest of Modise. He was granted bail and remained out on bail until his conviction and sentencing.

During sentencing proceedings, State Prosecutor Zola Mpayipheli argued that Modise had disregarded the complainant’s autonomy and right to refuse sexual intercourse. The State submitted that he should have respected his partner’s decision and bodily integrity.

In mitigation of sentence, the court took into account that Modise is employed, financially supports the complainant, maintains their three-year-old daughter, and is a first-time offender.

After considering all the circumstances of the matter, the court sentenced Modise to eight years’ imprisonment. In addition, he was declared unfit to possess a firearm and prohibited from working with children.

The Director of Public Prosecutions in the North West, Dr Rachel Makhari, welcomed the sentence, stating that although some may regard it as lenient, it reinforces the important legal principle that consent is essential in all sexual relationships, including intimate partnerships.

“This sentence sends a clear message that no person is entitled to engage in sexual activity without the consent of the other party. Partners must respect each other’s decisions and bodily autonomy at all times,” said Dr Makhari.

The NPA remains steadfast in its commitment to protecting victims of sexual offences, holding perpetrators accountable, and ensuring that justice is served for survivors of gender-based violence.
