NPA SECURES FIVE-YEAR IMPRISONMENT FOR VIOLATION OF PROTECTION ORDER

The National Prosecuting Authority (NPA) welcomes the conviction and sentencing of Frans De Wee, who was found guilty of contravening a protection order by the Griekwastad Magistrates’ Court on 21 May 2023.
This case represents a firm step forward in the fight against gender-based violence and the protection of vulnerable individuals who rely on the justice system for safety and dignity.

On the day of the incident, the complainant was at home when the accused returned from a recreational outing. She was in bed when he demanded her SASSA card, a demand she bravely refused. The accused proceeded to the kitchen, and as the complainant stood up to relieve herself, he threw a tin container filled with hot water at her. The attack caused severe injuries, requiring medical treatment.

The State led compelling evidence, including two eyewitnesses and a J88 medical report detailing the extent of the complainant’s injuries.

The court found the accused’s version of events implausible and convicted him accordingly. The court sentenced Frans De Wee to five years of direct imprisonment, sending a clear message that the abuse of protection orders and acts of domestic violence will not be tolerated. No order was made under Section 103 of the Firearms Control Act 60 of 2000, as the accused had already been declared unfit to possess a firearm.

This ruling underscores the NPA’s unwavering resolve to confront gender-based violence with the full weight of the law. Protection orders are not mere pieces of paper they are lifelines for those at risk, and violating them is a serious offence. We commend the courage of the complainant and the work of the prosecution team in securing justice. The NPA will continue to prioritise such cases, ensuring that perpetrators are held accountable and victims are supported.
