LIFE IMPRISONMENT FOR RAPIST

The Madadeni Regional Court has sentenced a 45-year-old man to life imprisonment for the rape of a 19-year-old woman in Danhauser in August 2019. On the day of the incident, the complainant was walking home at around 6pm. She was alone, and the accused approached her from behind, asking her where she was coming from. Once they reached a dark place on the road, the accused strangled her and head-butted her on her mouth. The complainant fell, and then the accused pulled out a knife and placed it at her neck. He told her that he would kill her if she screamed and proceeded to rape her. Thereafter, he told her that he would kill her and her family members if she revealed what he had done.

The complainant went home and immediately informed her grandmother what had happened. The grandmother examined her and saw her injuries. They reported the case to the police, and the complainant was taken to the Madadeni Thuthuzela Care Centre (TCC) for the necessary support. The accused was subsequently arrested.

In the state’s case, Prosecutor Zama Zikalala led the evidence of the complainant, the doctor who examined her, as well as the grandmother who was the first reporter. In her evidence, the complainant told the court that she had been emotionally and physically affected by the incident. She said that the scars of the incident will be with her for the rest of her life. In addition to the life sentence, the accused was declared unfit to possess a firearm, and the court ordered that his name be entered into the National Register for Sex Offenders.

The imposition of a life sentence underscores the gravity of the crime and sends a strong, unequivocal message: sexual offences will not be tolerated in our society and will be met with the full force of the law. The National Prosecuting Authority (NPA) remains steadfast in its commitment to uphold the rule of law, pursue justice for victims, and safeguard the rights and dignity of all members of our society, especially the most vulnerable.
