BAIL DENIED FOR NPA OFFICIAL ACCUSED OF RAPE
Dzanani, Limpopo - A 47-year-old man who is a senior official in the office of the Director of Public Prosecutions: Limpopo Division, applied for bail in the Dzanani Magistrates Court. He is charged with 10 counts of rape of a 16-year-old girl since 2022. The names of the victim and the accused are concealed in order to avoid secondary victimisation of the victim.
The accused was arrested on 29 April 2025 after the child had reported to the mother that she had been raped by the accused since 2022 while she was 13 years old. This latest incident prompted her to report to the mother who then notified the uncle and the matter was then reported to Dzanani police station and the accused was arrested.
During the judgement, the court remarked that, “the state has a strong case, and there is a likelihood that the accused can interfere with the state witnesses. The safety of the accused can be compromised, and his release can cause public disorder.
The onus is on the applicant to prove that exceptional circumstances do exist, and that the interests of justice permit the applicant to be released on bail”. The court found that the applicant failed to show that exceptional circumstances exists and that the interests of justice permit his release on bail. The court then dismissed his application to be released on bail.
The matter has been remanded to 25 June 2025 for further investigations and the accused remains in custody.
