ADVOCATE MENZI SIMELANE: NATIONAL DIRECTOR OF PUBLIC PROSECUTIONS
NATIONAL PROSECUTING AUTHORITY - SOUTH AFRICA
Advocate Menzi Simelane has been appointed as the National Director of Public Prosecutions (NDPP) by the State President with effect from 1 December 2009. This appointment has been made in terms of Section 10 of the National Prosecuting Authority (NPA) act 32 of 1998.
Prior to this appointment, Advocate Simelane was already serving as the Deputy National Director of Public Prosecutions at the NPA, a position he held since October 2009.
Born in 1970, Advocate Simelane completed his B Proc degree in 1993, followed by the LLB in 1995. He was admitted as an Advocate of the High Court in 1996 and commenced pupillage at the Durban Bar. On successful completion thereof, he joined the Johannesburg Bar in 1997.
In 1999 he was appointed as the Commissioner for the Competition Commission. As the head of this government institution for 5 years he was involved in making decisions on mergers and acquisition and anti-competitive practices and their impact on the economy and the economic transformation agenda of government.
In June 2005, he was appointed Director-General of the Department of Justice and Constitutional Development, a position he held until the end of September 2009 before moving to the NPA as Deputy National Director of Public Prosecutions.
Advocate Simelane has previously held the following directorships:
Member of the Department of Trade and Industry Task Team on Competition Policy, from 1998 to 1999;
Member of the Regulatory Committee of the Department of Transport regulating ACSA, from 1998 to 1999;
Member of Gauteng Tourism Agency, from 1997 to 1999;
Board Member of Satour, from 1997 to 1999. As head of the NPA, Advocate Simelane shall have authority over the exercising of all the powers, and the performance of all the duties and functions conferred or imposed on or assigned to any member of the prosecuting authority by the Constitution, the NPA Act or any other law.
As the National Director of Public Prosecutions, and in accordance with section 179 of the Constitution, Advocate Simelane:
(a) must determine prosecution policy and issue policy directives as contemplated in section 21; (b) may intervene in any prosecution process when policy directives are not complied with; and (c) may review a decision to prosecute or not to prosecute, after consulting the relevant Director and after taking representations, within the period specified by the National Director, of the accused person, the complainant and any other person or party whom the National Director considers to be relevant.
He will also be responsible for the overall performance of the NPA and may make recommendations to the Minister of Justice and Constitutional Development on all matters relating to the NPA or the administration of justice as a whole. |
